TERMS & CONDITIONS

These Terms and Conditions (“Terms”) govern your use of the Rally! Trivia mobile application (“the App”), operated by Rally Studio (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to these Terms in full. If you do not agree, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you confirm that you are at least 13 years of age (or the minimum age of digital consent in your country, whichever is higher), that you have read and understood these Terms, and that you agree to be bound by them.

If you are under 18, you confirm that you have obtained parental or guardian consent to use the App and to make any in-app purchases.

2. Changes to Terms

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting a notice within the App. Your continued use of the App following such notification constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the App.

3. Account Registration

To access certain features of the App, you must create an account. You agree to:

Provide accurate, complete, and up-to-date information when registering

Keep your login credentials confidential and not share them with others

Notify us immediately of any unauthorised access to your account at support@rallystudio.ae

Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for fraudulent or abusive purposes.

4. In-App Purchases

4.1 General

The App offers optional in-app purchases including premium visual themes and other cosmetic features. All purchases are final and non-refundable except where required by applicable law or Apple’s refund policies.

4.2 Pricing and Currency

Prices are displayed in the local currency of your App Store region and are subject to change at any time. We are not responsible for currency conversion rates applied by your bank or Apple.

4.3 Subscriptions

The App does not currently offer subscription-based purchases. All purchases are one-time and provide permanent access to the purchased content, tied to your Apple ID.

4.4 Restoring Purchases

If you reinstall the App or switch devices, you can restore your purchases using the “Restore Purchases” function within the App, provided you are signed into the same Apple ID used for the original purchase.

4.5 Refunds

Refund requests must be submitted directly to Apple at https://reportaproblem.apple.com. We are unable to process refunds directly as all payments are handled by Apple.

4.6 Parental Controls

Parents and guardians are responsible for monitoring their children’s use of the App and any in-app purchases. We strongly recommend enabling Apple’s “Ask to Buy” feature for Family Sharing to prevent unauthorised purchases by minors.

5. Intellectual Property

All content within the App — including graphics, logos, themes, question content, music, sound effects, and the Rally! Trivia name — is the intellectual property of Rally Studio and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial enjoyment. You may not:

Copy, modify, distribute, or reproduce any part of the App

Reverse engineer, decompile, or attempt to extract source code

Use our name, logo, or branding without prior written permission

Create derivative works based on the App’s content

6. User Conduct

By using the App, you agree not to:

Use the App for any unlawful purpose or in violation of applicable laws

Attempt to hack, exploit, or manipulate the App or its backend systems

Use cheats, bots, or automated tools to gain an unfair advantage

Impersonate any person or entity or misrepresent your affiliation

Upload or transmit harmful, offensive, or inappropriate content

Interfere with other users’ enjoyment of the App

Violation of these conduct rules may result in immediate suspension or permanent termination of your account without notice or refund.

7. Online Multiplayer

The App includes an online multiplayer mode. By participating, you acknowledge that:

Game outcomes depend on your internet connection quality, for which we are not responsible

We may impose fair-play rules and may penalise or disqualify users found cheating

Online features may be modified, suspended, or discontinued at any time

We are not liable for any losses or disputes arising from online gameplay

8. Availability and Updates

We do not guarantee that the App will be available at all times. The App may be unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to update, modify, or discontinue any feature at any time. We are not liable for any loss or inconvenience arising from App unavailability.

9. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant the accuracy or completeness of any trivia questions within the App.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Rally Studio and its officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including loss of data, loss of profits, or loss of goodwill.

Our total liability to you for any claims shall not exceed the amount you paid to us in the 12 months preceding the claim, or AED 100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Rally Studio and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any third-party rights.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the UAE.

We encourage you to contact us first at support@rallystudio.ae to resolve any disputes informally before initiating formal legal proceedings.

13. Third-Party Links and Services

The App may contain links to third-party websites or services. These links are provided for convenience only. We have no control over and accept no responsibility for the content or privacy practices of any third-party services. We encourage you to review the privacy policies of any third-party services you use.

14. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, it shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and Rally Studio regarding your use of the App, and supersede all prior agreements or understandings relating to the same subject matter.
