TERMS & CONDITIONS

These Terms and Conditions (“Terms”) govern your use of the Rally! Trivia mobile application (“the App”), operated by Rally Studio (“we,” “us,” or “our”). By downloading, installing, or using the App on any platform, including through the Apple App Store or Google Play, you agree to these Terms in full. If you do not agree, do not use the App.

1. Acceptance of Terms and Eligibility

By accessing or using the App, you confirm that you are at least 13 years of age (or the minimum age of digital consent in your country, whichever is higher), that you have read and understood these Terms, and that you agree to be bound by them.

If you are under 18, you confirm that you have obtained parental or guardian consent to use the App and to make any in-app purchases.

We do not ask for your age or date of birth when you create an account. Age is self-declared: by using the App you represent that you meet the minimum age above. If you are under 13, you must not use the App.

2. Changes to Terms

We may update these Terms. For material changes affecting account holders, the App will display the updated Terms and require you to accept them before you continue using your account. If you do not agree, you can sign out and request deletion of your account. The effective date above identifies this version.

3. Account Registration

To access certain features of the App, you must create an account. You agree to:

• Provide accurate, complete, and up-to-date information when registering
• Keep your login credentials confidential and not share them with others
• Notify us immediately of any unauthorised access to your account at support@rallystudio.ae
• Take responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for fraudulent or abusive purposes.

4. In-App Purchases

4.1 General

The App offers optional one-time in-app purchases for eligible trivia categories and cosmetic items, including title packs, avatar borders, and bundles. The content, price, and availability of each offer are shown in the App before purchase. Refund rights under applicable law and app-store rules still apply.

4.2 Payment Processing

All real-money purchases are processed through the app store you downloaded the App from: Apple (via the App Store) on iOS devices, or Google (via Google Play Billing) on Android devices. The store presents the final price and handles payment under its applicable terms. We do not collect, store, or have access to your payment card details at any time.

4.3 Pricing and Currency

Prices are displayed in the local currency of your App Store or Google Play region and are subject to change at any time. We are not responsible for currency conversion rates applied by your bank, Apple, or Google.

4.4 One-Time Purchases

The App does not currently offer subscriptions. Purchases are one-time entitlements for use in the App, subject to these Terms, the availability of the App, and the app store’s rules. Your Rally account and the Apple ID or Google account used for the purchase may both be needed to restore access.

4.5 Restoring Purchases

If you reinstall the App or switch devices, use “Restore Purchases” in the Store while signed in to the Rally account and app-store account associated with the purchase. Cross-platform restoration is not guaranteed; contact support if an eligible purchase does not reappear.

4.6 Refunds

Because your purchase is processed by the app store, refund requests must be submitted to that store, not to us:

• Apple App Store: submit a request at https://reportaproblem.apple.com.
• Google Play: request a refund through the Google Play Store (Menu → Order history), subject to Google’s refund policy.

We are unable to process store payments or refunds directly, as all payments are handled by Apple or Google. This does not affect any refund rights you may have under applicable mandatory consumer-protection law.

4.7 Parental Controls

Parents and guardians are responsible for monitoring their children’s use of the App and any in-app purchases. We strongly recommend enabling Apple’s “Ask to Buy” (Family Sharing) or Google Play’s parental controls and Family features to prevent unauthorised purchases by minors.

5. Rally Points and Virtual Items

The App includes “Rally Points” (RP) and virtual items such as category unlocks, player titles, avatar borders, and bundles. These are a limited, personal licence to access digital content within the App. They are not money, legal currency, credit, or your property.

Rally Points can be earned through eligible gameplay, achievements, and Daily or Weekly Tasks, or granted by us (for example, through a promotional code). RP cannot be bought with real money and has not been offered for sale. Some games, including solo or unfinished online games, may not earn RP or progression; the App shows the applicable reward rules.

Rally Points and virtual items:

• have no monetary or cash value;
• cannot be redeemed, exchanged, or cashed out for money or anything of value outside the App;
• are non-transferable and cannot be sold, traded, gifted, or sublicensed to anyone;
• may be created, adjusted, reduced, expired, or removed by us, and their price or availability may change, at any time for legitimate reasons such as correcting errors or preventing abuse; and
• may be forfeited without compensation if your account is suspended, terminated, or deleted.

Promotional codes are personal and non-transferable, have no cash value, may be limited in number or time and may expire, and may be withdrawn or invalidated if obtained through error or fraud or used in breach of these Terms.

6. No Gambling; No Monetary Value

Rally! Trivia is a game of knowledge and skill provided for entertainment only. It does not offer gambling, betting, wagering, lotteries, or any game of chance played for money or for anything of monetary value.

Rally Points, scores, rankings, achievements, leaderboard positions, and any “rewards,” “prizes,” “bonuses,” or “podium” rewards are virtual only. They have no cash or monetary value, are not winnings, and cannot be exchanged, redeemed, withdrawn, or cashed out for money or anything of value. No real-world money can be won or lost by playing the App. Nothing in the App is intended to constitute gambling under the laws of the United Arab Emirates or any other jurisdiction.

7. Intellectual Property

All content within the App, including graphics, logos, category art, question content, music, sound effects, and the Rally! Trivia name, is the intellectual property of Rally Studio and is protected by applicable copyright, trademark, and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial enjoyment. You may not:

• Copy, modify, distribute, or reproduce any part of the App
• Reverse engineer, decompile, or attempt to extract source code
• Use our name, logo, or branding without prior written permission
• Create derivative works based on the App’s content

8. User Conduct

By using the App, you agree not to:

• Use the App for any unlawful purpose or in violation of applicable laws
• Attempt to hack, exploit, or manipulate the App or its backend systems
• Use cheats, bots, or automated tools to gain an unfair advantage
• Impersonate any person or entity or misrepresent your affiliation
• Upload or transmit harmful, offensive, or inappropriate content
• Interfere with other users’ enjoyment of the App

Violation of these conduct rules may result in immediate suspension or permanent termination of your account without notice or refund.

9. Online Multiplayer

The App includes an online multiplayer mode. By participating, you acknowledge that:

• Game outcomes depend on your internet connection quality, for which we are not responsible
• We may impose fair-play rules and may penalise or disqualify users found cheating
• Online features may be modified, suspended, or discontinued at any time
• We are not liable for any losses or disputes arising from online gameplay

Online lobbies may include up to 10 players. Quick Chat lets you send a limited set of preset phrases, emoji, and category choices to the players in your game lobby and, between questions, during a game. It does not allow free-text messages. Other players may see your message with your public name and avatar. You can turn Quick Chat off in its settings, block a player, and report a user through their public profile. We may restrict abusive use of Quick Chat or other social features under the Acceptable Use Policy.

10. Availability and Updates

We do not guarantee that the App will be available at all times. The App may be unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to update, modify, or discontinue any feature at any time. We are not liable for any loss or inconvenience arising from App unavailability.

11. Disclaimer of Warranties

The App is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant the accuracy or completeness of any trivia questions within the App.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Rally Studio and its officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including loss of data, loss of profits, or loss of goodwill.

Our total liability to you for any claims shall not exceed the amount you paid to us in the 12 months preceding the claim, or AED 100, whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless Rally Studio and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; or (c) your violation of any third-party rights.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates. Nothing in these Terms removes any mandatory consumer-protection rights you may have under the laws of your country of residence.

We encourage you to contact us first at support@rallystudio.ae to resolve any disputes informally before initiating formal legal proceedings.

15. Third-Party Links and Services

The App may contain links to third-party websites or services. These links are provided for convenience only. We have no control over and accept no responsibility for the content or privacy practices of any third-party services. We encourage you to review the privacy policies of any third-party services you use.

16. Platform-Specific Terms (Apple App Store and Google Play)

These Terms are concluded between you and Rally Studio only, and not with Apple Inc. (“Apple”) or Google LLC (“Google”). Rally Studio, not Apple or Google, is solely responsible for the App and its content.

16.1 Apple App Store

If you download the App from the Apple App Store, the following additional terms apply:

• This agreement is between you and Rally Studio only. Apple is not responsible for the App or its content.
• Your licence to use the App is a non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Rally Studio, not Apple, is solely responsible for providing any maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are Rally Studio’s responsibility.
• Rally Studio, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your use of it, including product-liability claims, any claim that the App fails to conform to any legal or regulatory requirement, claims under consumer-protection or similar legislation, and intellectual-property claims.
• In the event of any third-party claim that the App or your use of it infringes that third party’s intellectual-property rights, Rally Studio, not Apple, is solely responsible for the investigation, defence, settlement, and discharge of any such claim.
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

16.2 Google Play

If you download the App from Google Play, your use of the App is also subject to the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App or its content. Purchases and refunds made through Google Play are handled by Google and are subject to Google’s policies.

17. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the App ceases immediately, and any Rally Points or virtual items associated with your account may be forfeited. Provisions that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, it shall be modified to the minimum extent necessary to make it enforceable, or severed from these Terms. The remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, the Acceptable Use Policy, and the Account Deletion and Data Requests page, constitute the entire agreement between you and Rally Studio regarding your use of the App, and supersede all prior agreements or understandings relating to the same subject matter.
